§ 363A.25 — Exemption Based on Disability

Plain-Language Summary

Programs designed to help people with disabilities are allowed under the Human Rights Act. An employer may defend against a discrimination claim by showing that the employee's disability poses a serious health or safety threat, even with reasonable accommodation.

Practical Notes
If you have a disability and use a rehabilitation or habilitation program, this section confirms those programs are legal. If you file a workplace discrimination complaint, your employer can argue as a defense that your disability creates a serious safety risk – but the employer must prove this, not you.
