§ 363A.26 — Exemption Based on Religious Association

Plain-Language Summary

Religious organizations and schools controlled by religious groups are exempt from many parts of the Human Rights Act, consistent with First Amendment protections. They may prefer members of their own religion in admissions, employment, housing, and services related to marriage ceremonies. This exemption does not apply to their non-religious business activities.

Practical Notes
If you work for or interact with a church, mosque, synagogue, or religious school, they may give preference to people of their faith in hiring, admissions, and housing. They can also decline to provide services for marriage ceremonies that conflict with their beliefs. However, if the religious organization runs a secular business unrelated to its religious mission, the exemption does not apply to that business.
