§ 363A.36 — Certificates of Compliance for Public Contracts

Plain-Language Summary

Businesses with 40 or more employees that want state contracts over $100,000 must have a certificate of compliance from the Commissioner of Human Rights, which requires an approved affirmative action plan. The Commissioner can suspend or revoke certificates and fine businesses up to $5,000 per year per contract for not making a good faith effort to implement their plan.

Practical Notes
This law mainly affects businesses that bid on government contracts. Contractors must have an approved affirmative action plan to get and keep state contracts.
