§ 394.21 — Authority to Carry on County Planning and Zoning

This law gives Minnesota counties with fewer than 300,000 people (based on the 1950 census) the authority to do planning and zoning. Counties cannot use amortization to eliminate a lawful pre-existing use, except for adult-only businesses. Counties can still enforce nuisance laws.

Practical Notes
If you have a lawful use of your property that existed before a zoning change, the county generally cannot force you to stop that use by setting a deadline. However, public nuisances and adult-only businesses are exceptions to this protection.
