§ 394.36 — Nonconformities

Plain-Language Summary

This section protects pre-existing land uses that do not conform to new zoning rules. Nonconforming uses can generally continue, but if discontinued for more than one year or the building is more than 50% destroyed, the property must be brought into compliance. Special rules apply to residential properties in shoreland areas.

Practical Notes
Homeowners and seasonal cabin owners can repair, replace, and maintain nonconforming structures but cannot expand them. In shoreland areas, nonconforming lots of record may still be built on if setback, septic, and impervious surface requirements are met. Counties can impose reasonable conditions on rebuilding permits for damaged nonconforming structures.
