§ 41B.17 — Powers and Duties of Trustee

Plain-Language Summary

This section describes the powers of a trustee who oversees bond security for the Rural Finance Authority. The trustee can enforce bondholder rights, sue on the bonds, require the authority to account for funds, stop unlawful acts, and declare all bonds due if there is a default.

Practical Notes
Bondholders who own 25% or more of outstanding bonds can force the trustee to act. Any lawsuit must be filed in Ramsey County. Before declaring bonds due and payable, the trustee must give 30 days’ written notice to the governor, the authority, and the commissioner of management and budget.
