§ 429.071 — Supplemental Assessments; Reassessment

This section allows municipalities to fix problems with special assessments after they have been adopted. The council can issue supplemental assessments to correct errors or omissions, and can reassess property when a court sets aside an original assessment or when the council finds the assessment was excessive or invalid. When assessed land is later subdivided, the council can split the unpaid assessment among the new parcels.

Practical Notes
If a special assessment against your property was set aside by a court, be aware that the city can come back with a new reassessment using proper procedures. Property owners who divide their land should request a formal reapportionment of any outstanding special assessments so each new parcel carries only its fair share. Appeals of reapportionment decisions follow the same 30-day window as appeals of original assessments under section 429.081.
