§ 430.02 — Proceedings for Acquisition of Lands

Plain-Language Summary

This section sets out the process for a city to acquire land for streets, parks, parking lots, and pedestrian malls. After passing the initial resolution, the city engineer must prepare a plat and survey of the proposed project and present it to the city council. The council then appoints commissioners to assess damages for property owners and assess benefits to other property.

Practical Notes
Property owners whose land may be affected by a city improvement project should track the process from the initial resolution. The engineers plat and survey defines what property will be taken and which surrounding properties may be assessed for project benefits. Property owners can request to review these documents.
