§ 430.03 — Objections; Appeal; Reappraisal

Plain-Language Summary

This section allows property owners to appeal the city commissioners award of damages or assessment of benefits from a land acquisition proceeding. An affected owner must file a written notice of appeal with the city clerk within 20 days of the city councils confirmation order and must post a bond to proceed.

Practical Notes
Property owners who disagree with the amount of damages offered for taking their property, or who object to being assessed for the cost of a nearby improvement, have 20 days to appeal to district court. If you receive a commissioners award, review it carefully with an attorney within that 20-day window because missing the deadline will bar your appeal.
