§ 466.04 — Maximum Liability

Sets maximum dollar limits on municipal tort liability, currently capped at $500,000 per claimant and $1,500,000 per occurrence for claims arising on or after July 1, 2009, and prohibits punitive damages against municipalities.

Practical Notes
These caps are significant. Even if your damages exceed these limits, the municipality’s liability is capped. The limits double for hazardous substance claims. Officers and employees have the same caps unless they also work privately in the same profession.
