§ 490A.02 — Judicial Standards Board; Powers

Plain-Language Summary

This law gives the Board on Judicial Standards and the Minnesota Supreme Court the power to discipline judges. A judge charged with a felony is automatically disqualified from hearing cases. The Supreme Court can suspend, censure, retire, or remove a judge for criminal conduct, disability, incompetence, or behavior that brings the court system into disrepute.

Practical Notes
A judge who is removed by the Supreme Court can never serve as a judge again in Minnesota. A removed judge’s right to practice law is referred to the appropriate authority for review. Judges who are retired by the Supreme Court still keep their pension benefits.
