§ 500.20 — Defeasible Estates

Property ownership that can be lost if certain conditions are not met (defeasible estates) is regulated by this section. Conditions that are merely nominal and provide no real benefit can be ignored. Private deed restrictions expire after 30 years unless they fall within certain exceptions (like condominiums or common interest communities). The right to reclaim property for a broken condition must be exercised within six years.

Practical Notes
If your property deed has old restrictions or conditions, they may no longer be enforceable if they are over 30 years old or are merely nominal. If someone has a right to take back property because a condition was broken, they must act within six years.
