2025 Session Last amended: 2014 session

§ 507.02 — Conveyances by Spouses; Powers of Attorney

Plain-Language Summary

If you are married and want to sell or transfer your homestead (the home you live in), both spouses must sign the deed. Either spouse can sell non-homestead property they own on their own. A spouse can also use a power of attorney to have someone sign on their behalf.

Practical Notes
This is one of the most important rules in Minnesota real estate. If only one spouse signs a homestead deed, the deed is not valid. Title companies and buyers should always check marital status before closing.
