§ 507.235 — Filing Contracts for Deed

Plain-Language Summary

All contracts for deed must be recorded at the county recorder's office within four months. For residential contracts for deed, the seller must give the buyer a recordable copy, pay any back taxes needed for recording, and record the contract. Failure to record can result in a penalty of two percent of the contract amount.

Practical Notes
This law protects contract-for-deed buyers by making sure the contract is recorded, which gives public notice of the buyer’s interest in the property. Sellers of residential property bear the main responsibility for recording.
