§ 514.16 — Severance of Building, Resale, Receiver

This section allows a court to order just the building or improvement sold separately from the land, if it can be removed without major damage. The buyer gets 60 days to remove it. The court can also appoint a receiver to manage the property.

Practical Notes
In some lien cases, the court may order only the building sold, with the buyer able to remove it. The landowner can stop the removal by paying the buyer the sale price plus expenses. The court can also appoint a receiver instead of ordering a sale.
