§ 514.71 — Release

Plain-Language Summary

This section requires the hospital lienholder to join in any release of the patient's legal claims. The hospital can also sue directly to enforce its lien. The lawsuit must be filed within two years after the lien is filed.

A hospital lien means that no settlement or release of the patient’s injury claims is valid unless the hospital agrees to it. The hospital can also file its own lawsuit to enforce the lien, but must do so within two years.
