§ 515B.3-107 — Upkeep of Common Interest Community

Practical Notes
If damage results from a unit owner’s failure to maintain their unit, that owner is responsible – and the same goes for the association’s neglect of common elements. The board must have a written preventative maintenance plan, maintenance schedule, and maintenance budget for common elements, and must share these documents with all unit owners. The association has the right to enter any unit to perform maintenance it is responsible for or to address health, safety, or code violations.
