§ 515B.4-106 — Purchaser's Right to Cancel

Gives buyers of new units in a common interest community the right to cancel the purchase agreement within ten days of receiving the disclosure statement, if the statement was not provided more than ten days before the purchase agreement was signed. A declarant who fails to deliver a compliant disclosure statement is liable for at least $5,000 in damages.

Practical Notes
If you are buying a new unit directly from the developer, you must receive a disclosure statement. If you did not receive it at least ten days before signing the purchase agreement, you have a ten-day right to cancel after receiving it. The seller cannot condition the sale on you waiving this right, and any waiver must be a separate signed document executed more than three days after you received the disclosure. Cancellation must occur before conveyance, is penalty-free, and all deposits must be promptly refunded.
