§ 515B.4-108 — Purchaser's Right to Cancel Resale

Gives buyers of resale units in a common interest community the right to cancel the purchase agreement within ten days of receiving the required resale disclosure information, if that information was not provided at least ten days before the purchase agreement was signed.

Practical Notes
When buying a condo or townhome from another owner (not the original developer), the seller must provide resale disclosure information under section 515B.4-107. If you did not receive it at least ten days before signing the purchase agreement, you have ten days after receiving it to cancel. As with new-unit disclosures, the seller cannot require you to waive this right as a condition of sale, and any waiver must be a separate document signed more than three days after you received the information. Cancellation is penalty-free and all payments must be promptly refunded.
