§ 518A.65 — Driver's License Suspension

Plain-Language Summary

If a parent falls behind on child support by three months or more and does not have a payment agreement, the court or the child support agency can suspend their driver's license. The parent gets at least 90 days to set up a payment plan before the suspension takes effect.

Practical Notes
When this applies: When a parent owes at least three times the monthly support amount in arrears and has no payment agreement. Who this affects: Parents who owe child support arrears. Key points: The parent must receive written notice at least 90 days before suspension. The parent can avoid suspension by entering into a written payment agreement. The court can also consider whether suspension would actually help collect support or would cause harm to the parent or children. A parent whose license is suspended can apply for a limited license for 90 days. The license can be reinstated once the parent complies with a payment agreement. The child support agency has discretion to skip suspension in certain situations, such as when the parent is incarcerated, disabled, receiving public assistance, or needs the license for work.
