§ 524.2-114 — Parent Barred From Inheriting in Certain Circumstances

Plain-Language Summary

A parent cannot inherit from their child if the parent's rights were terminated, or if the parent abandoned, abused, or neglected the child. If the child died as an adult, the parent is also barred if they were estranged from the child in the year before death.

Practical Notes
When this applies: When a child dies and a parent who lost parental rights or was absent tries to claim an inheritance. Who this affects: Parents whose parental rights were terminated, and parents who abandoned, abused, or neglected their children. Key points: A barred parent is treated as if they died before the child; this law does not apply to federal trust land in Tribal probate matters.
