§ 524.3-1203 — Summary Proceedings

Plain-Language Summary

Minnesota allows a simplified probate process called summary proceedings for smaller or simpler estates. If the estate is worth $150,000 or less (not counting the homestead and exempt property), the court can close it quickly by paying priority debts and distributing the remaining assets directly to heirs.

Practical Notes
When this applies: When an estate qualifies for simplified handling due to small size or limited assets. Who this affects: Families dealing with small to moderate estates. Key points: Summary proceedings can be used when the estate has no assets, when all assets are exempt from debts, or when the gross estate (excluding homestead and exempt property) is $150,000 or less. The court can close the estate without a full probate administration. A personal representative may or may not be appointed. If a will is involved, a formal hearing to probate the will is still required.
