§ 524.3-914 — Unclaimed Assets

Plain-Language Summary

This section governs what happens when estate assets cannot be distributed because the person entitled to them cannot be found, refuses to accept them, or the assets otherwise cannot be paid over. The court may order the personal representative to deposit the property with the county treasurer, and amounts over $5,000 may be invested with interest credited to the county. The rightful person may reclaim the deposit (with collected interest) by petitioning the court within 21 years, after which no recovery is allowed.

Practical Notes
If you are owed money or property from a Minnesota estate but did not claim it, those unclaimed assets may have been deposited with the county treasurer rather than lost. You can petition the probate court to recover the deposit, but only within 21 years of the deposit, and notice must go to the county attorney and county treasurer. Beyond that window the funds are forfeited, so check promptly and keep documentation of your entitlement.
