§ 525.313 — Clearance for Medical Assistance Claims

Plain-Language Summary

Before the court can issue a decree assigning inherited property, the petitioner must get a clearance from the county showing whether the deceased person or their spouse received Medical Assistance (Medicaid). If there is a claim, it must be paid from the estate before property is distributed.

Practical Notes
Critical for anyone filing a descent petition, as Medical Assistance claims can reduce the amount of inherited property.
