§ 527.38 — Renunciation, Resignation, Death, or Removal of Custodian; Designation of Successor Custodian

Plain-Language Summary

A custodian can decline to serve, resign, or be removed by the court. The custodian can name a successor, or if the minor is at least 14, the minor can choose a replacement. If no one steps up, interested parties can ask the court to appoint a successor. The outgoing custodian must turn over all property and records to the new custodian.

Practical Notes
This section provides a complete framework for custodian transitions. A custodian who wants to step down should formally designate a successor and deliver all property and records. If a custodian is mismanaging property, family members or the minor (if 14 or older) can petition the court for removal.
