§ 540.18 — Damage by Minor; Responsibility of Parent, Guardian, and Minor

Parents or guardians are jointly responsible with their minor child (under 18) for damage the child intentionally or maliciously causes to people or property, up to $1,000. The child remains personally liable too. This rule does not apply to state agencies that have custody of minors.

Practical Notes
If your child under 18 deliberately damages someone’s property or injures someone, you can be held liable for up to $1,000 in actual damages (not emotional distress or punitive damages). This is in addition to any other legal liability that may exist. State foster care and corrections programs are exempt.
