2025 Session Last amended: 2014 session

§ 546.27 — Decision by the Court

Plain-Language Summary

When a judge decides a case without a jury, the decision must be in writing, and the findings of fact and conclusions of law must be listed separately. Judges must file their decisions within 90 days of the case being submitted. Child protection cases involving abuse or neglect must be decided within 15 days. Judges who miss these deadlines face review by the Board on Judicial Standards.

Practical Notes
The 90-day deadline is enforceable — a judge’s pay can be withheld for noncompliance. Litigants experiencing long delays in receiving a decision can ask the court administrator to check on the status. The shorter 15-day deadline in child protection cases reflects the urgency of those proceedings for children’s safety and welfare.
