2025 Session Last amended: 2008 session

§ 550.04 — Execution, How Issued; Contents

Plain-Language Summary

This section describes what a writ of execution must contain and how it works. The writ is a court order directed to the sheriff that tells the officer to collect money from the debtor's personal property first. If there is not enough personal property, the sheriff can then go after real property (land and buildings). The writ must state the court, the parties, the judgment amount, and accrued interest.

Practical Notes
If a creditor is trying to collect from you, the law requires the sheriff to try to collect from your personal property before going after your home or land.
