§ 559.211 — Restraining, Enjoining Proceedings to Terminate

Plain-Language Summary

A buyer under a contract for deed who receives a termination notice can ask the court for a temporary order to stop the cancellation while the buyer's claims or defenses are decided. The court can issue this order without requiring the buyer to post a bond if the buyer cannot afford one. If the court later finds the termination was invalid, the buyer can recover attorney fees.

Practical Notes
This is an important protection for contract-for-deed buyers who believe they have a legal defense against cancellation. You must act before the termination date. The court may require you to keep making payments during the case.
