§ 573.02 — Action for Death by Wrongful Act; Survival of Actions

When someone's death is caused by another person's wrongful actions, the family can file a lawsuit to recover money damages. The law allows recovery for the deceased person's suffering before death and the financial losses the family suffers because of the death. Practical Notes
Wrongful death lawsuits must generally be started within three years of the death and within six years of the wrongful act. For medical malpractice deaths, the three-year limit applies with additional restrictions. There is no time limit for deaths caused by murder. Punitive damages may also be awarded. The court divides the recovery among the surviving spouse and next of kin based on each person’s financial loss.
