§ 574.32 — Application of Payments

When a claimant on a public project payment bond receives a payment and knows (or should know) that it was for work or materials on a bonded public project, the claimant must show that the payment was applied to that project's account. If the claimant cannot prove this, their bond claim will be reduced by the amount they received but cannot account for.

Practical Notes
Subcontractors and suppliers who work on multiple public projects must keep careful records showing how each payment is applied. If a general contractor pays a lump sum covering multiple projects, the claimant must be able to trace how it was allocated. Failure to keep proper records can significantly reduce a payment bond claim.
