2025 Session Last amended: 2012 session

§ 578.17 — Hearing by Court; Determination of Death of an Absentee

Plain-Language Summary

Any interested person can ask the court to hold a hearing to officially declare a missing person dead. This can happen if the person was exposed to a specific danger, has been missing four or more years, or if their property or business needs court-authorized management. The court must notify all interested parties before the hearing.

Practical Notes
Once the court declares the person dead, their property is distributed according to their will or inheritance law (chapters 524 and 525). Notice must be published in a newspaper for three weeks and mailed to all interested parties. The court also has power to make orders protecting the missing person’s property and business even without declaring them dead.
