§ 580.032 — Request for Notice; Mailed Notice

Plain-Language Summary

Anyone with a right to redeem property after a foreclosure (such as a second mortgage holder) can record a request for notice with the county to be notified if the property is foreclosed. The person foreclosing must mail a copy of the sale notice to everyone who filed a request at least 14 days before the sale. Failure to mail the notice does not cancel the foreclosure but can result in a claim for money damages.

Practical Notes
If you hold a lien on someone else’s property, recording a request for notice is an important step to protect your interest. It ensures you will know about a foreclosure in time to take action, such as redeeming the property.
