§ 60B.12 — Court's Seizure Order

If the commissioner shows a court that an insurance company is in trouble and policyholders could be harmed by delay, the court can immediately order the commissioner to take control of the insurer's property, books, and records. The insurer is blocked from doing business or moving assets without the commissioner's written consent.

A court seizure order is a serious step that freezes an insurer’s operations. Importantly, the seizure itself does not count as a breach of the insurer’s contracts, so policyholders’ coverage rights are preserved during the process. The insurer gets a chance to appear in court and argue against continuing the seizure.
