§ 60B.17 — Powers and Duties of Rehabilitator

Plain-Language Summary

The rehabilitator has broad powers to reform and revitalize a troubled insurance company. The rehabilitator can hire and fire employees, manage the business, pursue legal claims against insiders who harmed the company, and create a reorganization plan. For HMOs, the rehabilitator can also transfer coverage to another organization.

Practical Notes
The rehabilitator essentially replaces the insurer’s management. If insiders committed fraud or breached their duties, the rehabilitator can sue them on behalf of the company. For HMO enrollees, coverage can be transferred to another health plan to ensure continuity of care.
