§ 60B.26 — Notice to Creditors and Others

Plain-Language Summary

The liquidator must notify all known and expected claimants about the liquidation by mail, notify insurance commissioners in other states, publish notice in a newspaper, and inform agents of their duties. Claimants must file their claims within a deadline set by the liquidator, which is between six months and one year after the order.

Practical Notes
If you have a claim against a liquidated insurer, pay close attention to the filing deadline. Once proper notice is given, the distribution of assets is final for all claimants, whether or not they actually received notice. The notice will also tell you about any guaranty association that may cover your claim.
