§ 60G.08 — Immunity

60G.08 IMMUNITY.
There shall be no liability on the part of, and no cause of action may be brought against the commissioner or the department or its employees or agents for any action taken by them in the performance of their powers and duties under this chapter.

Practical Notes
You cannot sue the commissioner or department staff for decisions they make while supervising an insurance company. This immunity encourages the state to take necessary action to protect policyholders without fear of personal liability.
