§ 611.24 — Chief Appellate Public Defender; Organization of Office; Assistants

Plain-Language Summary

The State Board of Public Defense appoints a chief appellate public defender who serves a four-year term and manages the office that handles criminal appeals. This office can hire assistant public defenders and other staff. The appellate public defender can use trial transcripts for appeals and post-conviction cases. When a prosecutor appeals a pretrial order, the defendant is entitled to reasonable attorney fees paid by the government.

Practical Notes
If you are convicted of a crime and want to appeal, the chief appellate public defender’s office handles your case if you qualify for a public defender. The office also handles post-conviction proceedings. If the prosecutor appeals a pretrial ruling in your case, you are entitled to have your attorney fees paid by the government unit that brought the charges.
