§ 61B.26 — Duties and Powers of Commissioner

Plain-Language Summary

This section describes the commissioner of commerce's role in overseeing the guaranty association. The commissioner must notify the board within three days when an insurer becomes impaired or insolvent. The commissioner can suspend or revoke the license of any member insurer that fails to pay assessments. Decisions by the association can be appealed to the commissioner, and the commissioner's decisions can be reviewed by a court.

Practical Notes
The commissioner serves as both a supervisor of the association and as the liquidator, conservator, or rehabilitator for domestic insurers that fail. If you disagree with a decision by the association, you have 60 days to appeal to the commissioner. The commissioner can fine member insurers that fail to pay assessments at least $100 per month. The commissioner’s decisions are subject to judicial review under the Administrative Procedure Act.
