§ 624.7141 — Transfer to Ineligible Person

Plain-Language Summary

This law makes it a felony to intentionally transfer any firearm to a person you know or should know is legally prohibited from possessing one. If the person who receives the firearm uses it in a violent felony within a year, the penalty increases significantly.

Practical Notes
When this applies: When someone sells, gives, or otherwise transfers a firearm to another person who is ineligible to possess it. Who this affects: Anyone who transfers firearms, whether through private sales, gifts, or other means. Key points: Transferring a firearm to a known ineligible person is a felony punishable by up to 2 years in prison and a $10,000 fine; if the recipient uses the firearm in a violent felony within one year, the penalty increases to up to 5 years and $20,000; the law does not apply if the recipient later becomes eligible before committing any crime; an affirmative defense exists for family or household members who transferred the firearm under compulsion or threat of violence from the recipient.
