2025 Session Last amended: 2020 session

§ 626.085 — Search Warrant Required for Electronic Communication Information

Plain-Language Summary

This section allows a judge to issue a search warrant based on sworn testimony given over the telephone or by other electronic means, as long as the conversation is recorded. The judge must be satisfied there is probable cause, just like with an in-person warrant application.

Practical Notes
You would care about this if police obtained a search warrant by phone rather than appearing before a judge in person. Phone warrants are legal in Minnesota, but the call must be recorded and the judge must still find probable cause.
