§ 626A.38 — Register, Trap and Trace Device, or Mobile Tracking Device

Plain-Language Summary

The assistance of service providers may be required for installing pen registers, trap and trace devices, or mobile tracking devices. Providers must help carry out the court order and must be compensated for their expenses. The existence of the surveillance and the court order must be kept secret.

Practical Notes
If your phone company receives a court order to install a pen register or tracking device, they are legally required to assist. They must keep the surveillance secret. This means your phone company cannot tell you about the surveillance while it is ongoing.
