§ 62M.09 — Staff and Program Qualifications

Plain-Language Summary

This section requires that people who review medical care decisions must be properly trained and licensed. A doctor must make all denials based on clinical reasons, and that doctor must practice in the same or similar specialty as the treatment being reviewed. Mental health denials must be reviewed by a psychiatrist or licensed psychologist. Dentists and chiropractors must review denials in their fields.

Practical Notes
If your insurance denies care, the person making that decision must be a licensed doctor in the relevant specialty. A heart surgery denial must be reviewed by a heart specialist, not a general practitioner. Mental health denials require review by a psychiatrist or doctoral-level psychologist. This ensures that qualified professionals make these important decisions about your care.
