§ 638.19 — Reapplying for Clemency

After the Board of Pardons denies a clemency application, you must wait five years before applying again. You can ask for an early reapplication only if you have new and important information that was not available before.

Practical Notes
Being denied a commutation does not stop you from later seeking a pardon once you meet the eligibility requirements. If you have new evidence or changed circumstances, you may request a waiver of the five-year waiting period.
