§ 64B.38 — Certain Organizations Exempt

Plain-Language Summary

This law exempts certain organizations from the fraternal benefit society rules. Exempt groups include Masons, Odd Fellows, Elks, and Knights of Pythias lodges that do not issue insurance certificates, associations limited to one hazardous occupation, small local lodges with limited benefits, and religious aid associations with death benefits under $2,000. The Commissioner can require information to determine if an organization qualifies for an exemption.

Practical Notes
Not every fraternal organization needs to follow Chapter 64B. Small lodges, employee associations, and certain religious groups with limited benefits may be exempt. However, exempt organizations cannot pay anyone commissions for recruiting new members. If your organization is unsure whether it is exempt, the Commissioner can make that determination.
