§ 1.12 — Federal Flowage Easements Over Highways

Plain-Language Summary

When the commissioner of transportation asks, the governor can sell or grant flowage easements to the federal government on state-owned highway land. A flowage easement allows water to flow over and flood parts of the highway right-of-way for a public improvement project.

Practical Notes
This comes into play when federal water projects like dams or flood control systems would cause water to cover parts of state highways. The governor has the authority to grant the necessary easements to make these projects possible.
