§ 103D.105 — Board Hearings

Plain-Language Summary

This section explains how the Board of Water and Soil Resources holds hearings. Rulemaking hearings follow Chapter 14. Other hearings can be run by the board or referred to an administrative law judge. For noncontroversial plans, the board can skip a hearing if no one objects within 30 days.

Practical Notes
If you want to challenge a watershed management plan, you must submit a written request for a hearing within 30 days of the last notice publication. If no one requests a hearing, the board can approve the plan without one. Notice is published in legal newspapers and mailed to affected counties and cities.
