§ 103D.111 — Appeal of Board Orders

Plain-Language Summary

This section explains how to appeal decisions made by the Board of Water and Soil Resources. For decisions about creating or ending a watershed district, a local government or 25 residents can demand a formal hearing before an administrative law judge. Final board decisions can be appealed to the Court of Appeals.

Practical Notes
If you disagree with a board decision to establish or end a watershed district, you need either a local government or at least 25 affected residents to demand a contested case hearing. Hearing costs may be split among the parties based on who prevailed. After the board makes a final decision, appeals go to the Minnesota Court of Appeals under sections 14.63 to 14.69.
