§ 103D.205 — Establishment Petition

Plain-Language Summary

This section explains how to file a petition to create a new watershed district. The petition must include the proposed name, description of the area, reasons the district is needed, a map, and manager nominees. It must be signed by enough counties, cities, or at least 50 resident owners.

Practical Notes
To start a watershed district, you need signatures from at least half the counties in the area, counties covering 50% of the area, a majority of cities, or 50 resident owners. The petition must nominate at least twice as many manager candidates as positions. Managers cannot be state, county, or federal officials, except soil and water conservation supervisors. Defective petitions can be amended before the hearing ends.
