§ 103D.225 — Hearing and Order to Establish

If the board decides the district would benefit the public, it issues an order creating the district with its name, boundaries, and first managers. The district becomes a political subdivision of the state.

Practical Notes
The first board of managers has 3 to 9 members, with staggered terms. Metropolitan-area districts must have at least 5 managers nominated by affected cities and towns. The district officially exists once the establishment order is filed with the Secretary of State. A manager cannot serve as a county, state, or federal public officer at the same time.
